I, the undersigned, certify that I am the parent or legal guardian of the child named on the form and that the child is a student at Montessori Community School, Salt Lake County, State of Utah. In the event of an emergency, natural disaster or accident at Montessori Community School, if the parents (or legal guardians) cannot be immediately contacted, I, the undersigned, grant full power of attorney to whomever Montessori Community School designates, to do as follows:

  1. To arrange for the transportation of my child, whether by ambulance or otherwise, to a proper facility where emergency medical treatment would normally be administered, including, but not limited to, an emergency room of a hospital, a doctor’s office, or a medical clinic; and
  2. To sign any releases as may be required in order to obtain any medical or surgical treatment as is required in the judgment of medical authorities at the facility.
  3. If medical treatment is sought, the responsibility to pay for said services shall be the sole responsibility of the parent or legal guardian.

I am aware that accidents may occur, that there are inherent risks associated with attending school, and/or medical emergencies may occur. Montessori Community School does not have trained medical personnel on staff. School staff have basic CPR/First Aid training.  I understand supervision of treatment and emergency action will be undertaken by non medically qualified staff and within the constraints of other duties. I waive and agree to waive claims against the school, its agents, employees, students, or parents/caregivers of other students from damages except in cases of gross negligence. This agreement shall be enforceable on the heirs and assigns of all who sign or are mentioned in this agreement.

Authorization to Use Medical Information for the Benefit of the Student

I, the undersigned, certify that I am the parent or legal guardian of the child named on the form and that the child is a student at Montessori Community School, Salt Lake County, State of Utah. I hereby expressly authorize Montessori Community School & professional consultants retained to assist in educating my child to have access to necessary medical, physiological and any other relevant information pertaining to the specific needs of my child. I understand said information will be used solely for the benefit of my child. In such circumstances, all such information shall be kept confidential in compliance with applicable State Statute and Federal Law.

Medication

I am aware that I must submit a form with the medication name, the dosage and when it should be administered. I hereby give authorization for the staff of the Montessori Community School to administer any medications on the Medical Release form. I recognize that the staff will not be held liable for any illness or injury resulting from the administration of this medication, and will not be held responsible for reimbursement of medical expenses resulting from such action.  I understand that prescription medication must be in the container in which it was prescribed and must be specifically for the child named.

Immunization Records

The Montessori Community School requires certain immunization records to be submitted at enrollment in order to better protect our entire community. These records are kept in strict confidence and maintained in compliance with Utah’s Health Department. Student Immunization Records will be shared with the Utah Health Department as Utah law requires and medical status will also be disclosed in the case of an outbreak or illness.

Field Trip Release

I, the undersigned, certify that I am the parent or legal guardian of the child named on the form and that the child is a student in Montessori Community School, Salt Lake County, State of Utah. I understand my child will be traveling on field trips/tours sponsored by the school and there will be multiple field-trips throughout the year. If the parent or legal guardians cannot be immediately contacted, I, the undersigned, grant full power of attorney to whomever Montessori Community School designates as the director in charge of the field trip, in the event of an accident or illness involving my student at any time from the commencement to the termination of the field trip, to do as follows:

  1. To arrange for the transportation of  my child whether by ambulance or otherwise, to a proper facility where emergency medical treatment would normally be administered, including, but not limited to, an emergency room of a hospital, a doctor’s office, or a medical clinic; and
  2. To sign any releases as may be required in order to obtain any medical or surgical treatment as is required in the judgment of medical authorities at the facility.
  3. If medical treatment is sought, the responsibility to pay for said services shall be the sole responsibility of the parent or legal guardian.

I will not hold Montessori Community School, its agents or employees responsible in case of accident or injury as a result of this participation. Parent Participation Policy

I understand that Montessori Community School requires a minimum of ten (10) hours of Parent Participation for each child enrolled at Montessori Community School during each academic school year. Parent Participation hours may be fulfilled by helping in a variety of ways, including doing laundry for a classroom, driving on a field trip, assisting with PSA (Parent School Alliance) events, donating books or materials to a classroom, etc. Opportunities to support the school, classrooms and teachers are communicated throughout the year.

I am aware that my hours should be tracked on the FACTS Family Portal under the Family Home section in Service Hours. When adding Parent Participation Hours, I will ensure the correct family member is chosen at the top and the Verified By field will contain the school member I coordinated with to arrange my participation.

I further understand that hours will be approved by office administration and if the hours are not fulfilled by the end of the academic year, I pledge a $25/hour equivalent donation to MEF or an organization of my choosing from the school’s list of nonprofit organizations that have a mission of education or are in alignment with the core values and mission of MCS.

*While Parent Participation is highly encouraged, in-person volunteer hours may be suspended if there are unforeseen circumstances that prevent parent involvement at the school.

Volunteering

I understand that depending on the type of volunteering I choose, for instance volunteering in the classroom or with students directly, I may be required to submit a Motor Vehicle Report (MVR) and Background Check through Child Care Licensing. Before volunteers begin, I agree to coordinate with the school to obtain these items. Details and sign-up options are available in the welcome information or by contacting the school directly.

Privacy Policy

I am aware that Montessori Community School employs industry standard best practice to safeguard its online records including but not limited to, secure data centers,  256 Bit SSL encryption, and network firewalls. I understand that Montessori Community School therefore does not assume responsibility for inadvertent disclosures caused by breaches of the network or encryption.

Use of Student’s Information & Likeness

I understand that Montessori Community School will provide a student directory to our families upon request. Information included in this directory may be designated by parents in the Online Enrollment Form.

I agree that Montessori Community School reserves the right to share student information, as stated on our Online Enrollment Form, with related outside entities; some of these include but are not limited to our online record keeping system and our emergency notification system.

FERPA

The Family Educational Rights and Privacy Act (FERPA) gives parents and students over 18 (“eligible students”) the following rights to the student’s education records.

  1. The right to inspect and review the student’s education records within 45 days of the day the School receives a request for access. After parents or eligible students submit a written request to the director identifying the record(s) they wish to inspect, the director will arrange for access and tell the parent or eligible student when and where the records may be inspected.
  2. The right to request amendment of the student’s education records that the parent or eligible student believes are inaccurate or misleading. Parents or eligible students may ask for amendment of a record believed to be inaccurate or misleading by writing to the school director and clearly identifying the record to be changed and specifying why it is inaccurate or misleading. If the School decides not to amend the record, the School will notify the parent or eligible student of the decision and advise them of the right to a hearing.
  3. The right to consent to disclosure of personally identifiable information contained in the student’s education records, except as FERPA allows disclosure without consent. Three of the disclosures allowed without consent are:
  1. FERPA permits disclosure of education records without consent to school officials with legitimate educational interests. A school official is a person employed by the School as an administrator, supervisor, instructor, or support staff member; a School Board member; a person or entity the School has designated to perform a special task, such as a school resource officer; or a person serving on an official committee, such as a disciplinary committee, or assisting another school official in performing a responsibility. A legitimate educational interest exists if the official needs to review an education record in order to fulfill their responsibility as a school official.
  2. If a student plans to enroll in another school, MCS will disclose education records to the receiving school upon the receiving district’s request.
  3. FERPA permits disclosure of directory information without consent to third parties unless there is a timely written refusal. Unless parents or eligible students write to the school within 15 days after distribution of this notice to refuse disclosure of directory information, the information may be disclosed. Directory information may include a student’s: (i) name, (ii) address, (iii) telephone number, (iv) date and place of birth, (v) participation in activities or sports, (vi) weight and height of athletic team members, (vii) images (photo, video, etc.), (viii) awards, degrees and honors, (ix) dates of enrollment and (x) grade level and major field of study.
  1. The right to file a complaint with the U.S. Department of Education. The Office administering FERPA is the Family Policy Compliance Office, 600 Independence Avenue, SW, Washington D.C. 20202-4605.

Student Likeness Release

Montessori Community School requires your permission to reproduce, through printed, audio, visual, or electronic means, recordings of school activities in which you or your child has participated and which are related to the school’s mission.

I am aware that in an effort to protect the privacy of each student, Montessori Community School staff may use first names to identify each student on Montessori Compass and other platforms used internally by the school, parents and organizations associated with the school.

I authorize the school to make reasonable use of recordings of school activities in which I or my child are involved in order to train teachers, increase awareness, and promote continuation and improvement of programs through the use of mass media, displays, brochures, websites, social media and other means of communication.

I authorize the use of my child’s image/likeness or my image/likeness, and/or voice, without any compensation to me, for the school and/or its authorized representatives to own exclusive right, title, and interest, including copyright and/or any other property interest, in these Recordings. I agree that the school and/or its authorized representatives shall have the unlimited right to use the Recordings for any purposes stated or related to the school.

I understand that due to the nature of digital media, the school has no control over parents or other users sharing a student's image/likeness online.

I understand that I may request to have my child’s image removed from the school’s public marketing materials. Should I choose to have my child's image removed from marketing materials I will contact the administrative office with a written request.

Indemnification

I hereby expressly agree to indemnify the school and waive my right to pursue any action against Montessori Community School and all of its agents, employees, students, and parents/caregivers of students  for all claims except those arising from gross negligence. I further expressly agree to waive any and all claims that may arise from an alleged violation of these provisions. If a parent, legal guardian, or authorized contact pursues legal action against Montessori Community School, its agents and / or employees, the moving party shall be responsible for the legal fees of the non-moving party, whether successful or not.

Email, Phone, Text Release

I am aware that in the case of an emergency, natural disaster, school closure, or other important update, crucial information will be sent school wide via text message, email and phone call. Charges accrued for these communications (ie; charges rendered by mobile carriers) will not be the responsibility of Montessori Community School.

I authorize that I have received permission from all additional contacts to add their information to the Montessori Community School system and that they have been notified of these terms and conditions.

Limited Use Key Card Policy

The purpose of this policy is to provide flexible access to Montessori Community School while also maintaining a safe and secure facility through the limited issuance of key cards.

At the beginning of each academic year (or when a student begins attending school) key card(s) may be issued on behalf of each student depending on family requirements. The purpose of the key card is to provide access during regular operating hours of 8:00am-6:00pm on school days only. Key cards will be used for school-approved entry to the facility only.

When requested, the school may issue an additional key card to a student’s approved authorized pick-up person or legal guardian. Cost for additional key cards will be $20 each. Requests must specify the name of the individual who will be using the key card, the student that the key card is associated with, and an alternative pick-up form must be submitted. Key cards issued will only work for the period for which each child is enrolled. Key card(s) for returning families may be reactivated once a family has completed the online enrollment form. The school officials may deactivate key cards at their discretion.

School approval of key cards for alternative pick-ups and guardians will be dependent upon the following:

Security of school facilities is the responsibility of our entire community. MCS administration appreciates diligence and attention to these important matters.

Access to the school may be restricted at times in response to emergency circumstances. In the event that this happens the school will not issue keycards and FOBs and/or disable access to existing keycards and FOBs.

Force Majeure

The School’s duties and obligations shall be suspended immediately without notice during all periods that the School is closed because of force majeure events including, but not limited to, any fire, act of God, hurricane, war, governmental action, act of terrorism, epidemic, pandemic, required quarantining, or any other event beyond the School’s control. If such an event occurs, the School’s duties and obligations will be postponed until such time as the School, in its sole discretion, may safely reopen. In the event that the School cannot reopen due to an event under this clause, or a student misses school as a result of an event under this clause, the School is under no obligation to refund any portion of the tuition paid.

Period of Agreement

I understand that I must agree to these Terms & Conditions in order for my child to attend Montessori Community School of Salt Lake City. I am aware that these Terms & Conditions change occasionally. I agree that the Terms & Conditions apply to myself and my enrolled child. The period to which these Terms & Conditions apply starts when I agree to them. I understand that I will be asked to sign updated Terms and Conditions periodically throughout my student’s enrollment at MCS. I understand that I may revoke my agreement to these Terms & Conditions at any time by writing to the school and that doing so will change my student’s enrollment status to withdrawn as soon as the request is received by the school.

Digital Signature

By selecting the "I Agree" button associated with this link and typing my name as a signature, I am signing this Agreement electronically and agreeing to digital signature. For this document and all documents -- terms of use, privacy policy, disclosures, and other school related documents or Montessori Community School documents and forms -- I agree my digital signature is the legal equivalent of my hand written signature.

By selecting "I Agree," I consent to be legally bound by this Agreement. I further agree that my use of a keypad, mouse or other device to select an item, button, icon or similar act/action, or to otherwise provide Montessori Community School, or in accessing or making any transaction regarding any agreement, acknowledgement, consent, disclosures or conditions, with Montessori Community School or a third party using Montessori Community School system, constitutes my signature (hereafter referred to as "E-Signature"), acceptance and agreement, as if actually signed by myself in writing. I also agree that no certification, authority or other third party verification is necessary to validate my E-Signature and that the lack of such certification or third party verification will not in any way affect the enforceability of my E-Signature or any resulting contract between myself and Montessori Community School, or myself and third parties using Montessori Community School system. I further agree that each use of my E-Signature in obtaining a Montessori Community School service constitutes my agreement to be bound by the terms and conditions of this Agreement as it exists on the date of my E-Signature. Montessori Community School  will revise and update this Policy if practices and policies change, as technology changes, or as new services are added or existing services are changed. If the school makes any material changes to this Policy, the changes will be updated at: https://mcsslc.com/terms along with a change of date.
